1. Terms & Conditions for Medical Tourism Services

These Terms & Conditions (“Terms”) govern the relationship between BE UTOPIAN TECHNOSOFT PRIVATE LIMITED (operating under the brand name “Wellness Nine”) (“Service Provider”) and the End User (“Client”) in connection with the facilitation of medical tourism services.

By accepting these Terms, the Client agrees to be bound by the following:

2. Nature of Services Provided

2.1 The Service Provider acts solely as an intermediary or facilitator connecting Clients with third-party medical professionals, hospitals, clinics, or healthcare institutions ("Medical Providers") located domestically or internationally.

2.2 The Service Provider does not provide medical advice, diagnosis, treatment, or recommendations. All medical decisions are made solely between the Client and the Medical Providers.

2.3 The Service Provider facilitates:

  • Communication between Client and Medical Providers
  • Appointment scheduling
  • Logistical arrangements including travel and accommodation (if opted)
  • General information about treatment options and providers

3. No Medical Liability

3.1 The Service Provider is not a healthcare provider and does not represent itself as such.

3.2 The Service Provider is not liable for:

  • The quality, safety, or success of medical procedures
  • Medical malpractice, negligence, or errors committed by Medical Providers
  • Post-treatment complications, side effects, or adverse outcomes

3.3 The Client understands that all medical services are rendered by third-party Medical Providers, who are independent entities not employed or controlled by the Service Provider.

4. Client Responsibility and Acknowledgment

4.1 The Client assumes full responsibility for:

  • Verifying the credentials and qualifications of Medical Providers
  • Understanding the risks associated with medical treatments
  • Making informed decisions regarding medical care
  • Obtaining any necessary travel visas or insurance

4.2 The Client agrees to perform due diligence and consult with appropriate professionals before proceeding with any treatment.

4.3 The Client agrees to release and hold harmless the Service Provider from any claims, liabilities, damages, or losses arising out of or related to medical services provided by third-party Medical Providers.

5. Limitation of Liability

5.1 To the fullest extent permitted by applicable law, the Service Provider shall not be liable for:

  • Direct, indirect, incidental, consequential, punitive, or special damages
  • The Client’s use of or reliance on Services
  • Any act or omission of Medical Providers
  • Travel-related issues including delays, cancellations, or accidents

5.2 In no event shall the Service Provider's total liability exceed the amount paid by the Client for the facilitation services.

6. Payment Terms

6.1 The Client agrees to pay the Service Provider the facilitation fees, which shall include the consultancy fees of the doctors, in advance as specified in the service package or agreement.

6.2 Fees paid to the Service Provider are non-refundable, except in cases of proven failure to deliver agreed facilitation services.

6.3 Refunds: In the event that a confirmed appointment is cancelled, the Service Provider will process the applicable refund within forty-eight (48) hours of cancellation. All refunds will be made after deducting applicable taxes, bank charges, or other statutory deductions, as per prevailing laws.

7. Confidentiality and Data Use

7.1 The Service Provider will handle the Client’s personal and medical information in accordance with applicable data protection laws.

7.2 By using the Services, the Client consents to the sharing of necessary personal and medical information with relevant Medical Providers for the purpose of treatment facilitation.

8. Governing Law and Dispute Resolution

8.1 This Agreement shall be governed by and construed in accordance with the laws of INDIA.

8.2 Any disputes arising under or in connection with this Agreement shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, INDIA.

9. Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Agreement constitutes the entire agreement between the Client and the Service Provider with respect to the subject matter and supersedes all prior understandings or agreements, whether written or oral.
